Terms and Conditions

  1. Application and Entire Agreement
    1. These Terms and Conditions will apply to the purchase of the goods and services detailed on our website (Goods) by the buyer, or user if different, (you or your) from Releasing Strengths Ltd of 23 Rushworth Road, Surrey, RH2 OQF UK (we, our or us).
    2. If the buyer is not the same as the user, the buyer should make the user aware of these Terms and Conditions and ensure they are acceptable before use.
    3. These Terms and Conditions will be deemed to have been accepted by you when you accept them at the time of order and will constitute the entire agreement between us and you.
    4. These Terms and Conditions apply to the purchase and sale of any Goods between us and you, to the exclusion of any other terms that you try to impose or incorporate, or which are implied by trade, custom, practice or course of dealing.
    5. This Agreement shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the jurisdiction of the English and Welsh courts.
  2. Interpretation
    1. The buyer is the person making the financial transaction to obtain the goods.
    2. The user is the person using or operating the goods.
    3. A “business day” means any day other than a Saturday, Sunday or bank holiday in England and Wales.
    4. Business hours are 09:00 to 17:00 in the UK time zone, GMT+0 or BST (GMT+1).
    5. The headings in these Terms and Conditions are for convenience only and will not affect their interpretation.
    6. Words imparting the singular number include the plural and vice-versa.
    7. The description of the Goods is set out in our sales documentation unless expressly changed in our quotation.
    8. Descriptions of the Goods set out in our sales documentation are intended as a guide only.
    9. We can make any changes to the specification of the Goods which are required to conform to any applicable technical or other statutory or regulatory requirements without liability.
    10. A Base Product can function in its own right, such as Cascade. An Add-on product requires a Base Product to function, for example, the Bonus Pack.
  3. Payment
    1. No Goods or services will be supplied until full payment has been received.
    2. The date of payment will be the start of the Contract between us and you.
    3. All payments must be made by one of the currencies available on our website unless otherwise agreed in writing by us.
  4. Tax
    1. Buyers in the EU Member States and the UK are charged VAT at the local rate unless a VAT Registration Number validated by VIES (VAT Information Exchange System) is supplied at the time of order.
    2. Buyers in other countries are zero-rated for UK tax purposes.
    3. We accept no responsibility for the failure of the buyer or the user to comply with any legal requirements in their country. It is the buyer’s responsibility to ensure that they adhere to their local tax laws and any other relevant legalisation.
  5. Delivery and Cancellation
    1. Delivery of digital goods or services via email or a download link are usually sent within 24 hours, subject to weekends and UK Bank Holidays.
    2. Notification of non-delivery for digital goods or services must be made within 7 days from the date of order.
    3. Cancellations and refunds for digital goods are not available once the download has started.
    4. Cancellations for digital services are only available before the service is sent to the buyer.
  6. Copyright
    1. Cascade is subject to Copyright © 2022 Releasing Strengths Ltd. It cannot be decompiled or modified beyond its intended use.
    2. Documentation resulting from Cascade may be circulated to third parties, in printed or electronic form (.PDF), without written permission provided the copyright notices remain intact on the documents.
    3. Gallup®, Clifton Strengths® and the 34 theme names of Clifton Strengths® are trademarks of Gallup, Inc. All rights reserved. To learn more about CliftonStrengths®, please visit www.gallupstrengthcenter.com.
    4. This product contains certain Gallup trademarks and copyrighted material and is used herein pursuant to license. The author’s information has not been approved and is not sanctioned or endorsed by Gallup in any way. Opinions, views and interpretations of CliftonStrengths® are solely the beliefs of Releasing Strengths Ltd.
  7. Licence and Usage
    1. The user is not permitted to electronically distribute Cascade or use it beyond the limits of the licence. Sharing the entire Cascade file with any other person is prohibited.
    2. Each purchase of Cascade is licensed in one of the following ways;
      1. Cascade Personal – use by an individual who is the exclusive user of Cascade.
      2. Cascade Professional – use by several individuals working for the same organisation in the same location. The location is defined as the same town or city.
  8. Limitation of liability
    Our total liability under any of the following sections will not, in any circumstances, exceed the total amount of the Price paid by you.
    1. Our liability under the Contract, for breach of statutory duty, tort, misrepresentation or otherwise will be limited to this clause.
      1. We will not be liable for:
        1. any indirect, special or consequential loss, damage, costs, or expenses; and/or
        2. any loss of profits; loss of anticipated profits; loss of business; loss of data; loss of reputation or goodwill; business interruption; or, other third-party claims; and/or
        3. any failure to perform any of our obligations if such delay or failure is due to any cause beyond our reasonable control; and/or
        4. any losses caused directly or indirectly by any failure or breach by you in relation to your obligations; and/or
        5. any loss relating to the choice of Goods and how they will meet your purpose or the use by you of the Goods supplied.
    2. Backup and Liability
      1. a. The Buyer and the User are responsible for providing a compatible platform for Cascade. The technical requirements for Cascade are set out in the Cascade shop.
      2. The user is responsible for the safeguarding and the backup of data in Cascade. No responsibility or liability will be accepted by Releasing Strengths for any data loss or any impact it may have, however caused.
    3. Updates and Support
      1. The support service is to provide the technical use of Cascade to the purchaser.
      2. Where more than one person uses Cascade Professional, support will be provided to a single individual. This will be the purchaser unless Releasing Strengths is informed in writing, nominating an individual to be the support contact.
      3. The Support Service does not extend to;
        1. Use of Excel beyond the use of Cascade
        2. IT support beyond the internal use of Excel
        3. Coaching practices or other strengths development advice.
      4. The support service is available during UK Business hours on UK Business days.
      5. The support service is valid for 12 months from the date of purchase of the Base product.
      6. The support service for Add-on components is valid from the date of purchase for the Base product, irrespective of the purchase date for the Add-on component.
      7. Free updates are included for 12 months from the date of purchase of the Base product.
      8. The support for the updates will expire 12 months from the date of the original product purchase.
      9. The support service covers the transferring of client data to a new version of Cascade when requested. It is up to the user to transfer any customisations made to the look of the reports.
      10. Minor updates are announced via the Change Log where major updates are notified to customers within their support service by email.
      11. The email notifications are subject to successful opting in to receive such notifications.
      12. Updates can be requested at any time by contacting Releasing Strengths.
      13. Updates requested outside of the support period will be chargeable and subject to the same terms and conditions as Cascade.
      14. We offer no guarantee or commit to a timeframe for any bug fixes or repairs.
      15. No responsibility will be accepted for any loss arising as a result of delays from the support service.
  9. Personal Details
    1. Personal details will not be passed on or sold to any third party outside of our business operations, except where we have a legal requirement to do so.
    2. If we receive any client data (perhaps contained in a copy of Cascade received to resolve a support issue) any such data will be treated in the strictest confidence and will not be passed on to any third party, except where we have a legal requirement to do so.
    3. If you no longer wish to receive any marketing information from ourselves, please contact us with your request.
